TERMS & CONDITIONS
It is important that all of our users and visitors are able to enjoy the use of our paddocks safely. Please observe the following terms and conditions.
If any user or visitor breaches the terms and conditions, Cole Ambrose Ltd can at their absolute discretion, ask any user or visitor to leave Ely Dog Park and prevent them from using Ely Dog Park again in the future.
These terms and conditions may be updated from time to time. Cole Ambrose Ltd reserve the right to alter the terms and conditions without any prior notice.
1. Interpretation
1.1. Any reference made to ‘Ely Dog Park’, ‘Field’, or ‘Paddock’ refers to the land enclosed by the perimeter fences and gates, the communal Car Park and all fixtures and fittings.
1.2. Any reference made to the ‘site’ or ‘onsite’ refers to any land owned and operated by Cole Ambrose Ltd.
1.3. Any reference made to ‘You’, ‘Visitor’, ‘User’ or ‘Client’ refers to the person who has made the booking, the owner of any dog(s) or any visitors attending Ely Dog Park with the person who had made the booking.
2. Bookings, Cancellations and Closures
2.1. All bookings must be made in advance through the Ely Dog Park website, elydogpark.co.uk. It is not possible to take bookings over the phone.
2.2. All bookings are paid for in advance through our website. Cash cannot be accepted and must not be left at Ely Dog Park.
2.3. By making a booking, you agree to abide by these terms and conditions at the time of making your booking and during your visit to Ely Dog Park.
2.4. All bookings are non-refundable and cannot be cancelled.
2.5. You are able to reschedule your booking an unlimited amount of times via the website up to 4 hours before your session is due to start.
2.6. Ely Dog Park is open at specific times during the summer and winter seasons as published on the website. No access to the Field is allowed outside of these opening times.
2.7. Cole Ambrose Ltd reserve the right to close Ely Dog Park and/or withdraw permission for the use of Ely Dog Park at any time and for any reason. Such closures may be required, by way of example, for essential maintenance or severe weather conditions. If a booking needs to be cancelled by Cole Ambrose Ltd, then in it may seek to re-schedule the booking for an alternative time and date or refund any advance payment that has already been made. Cole Ambrose Ltd shall accept no liability for any other expenses incurred or loss sustained by the User as result of the use of Ely Dog Park being withdrawn or booking being cancelled.
3. Licence and Use of Ely Dog Park
3.1. Cole Ambrose Ltd grants the User a right to enter and use Ely Dog Park in accordance with these terms and conditions. The User acknowledges that:
3.1.1. The User and their visitors shall have the right to enter and use Ely Dog Park as a licensee only and no relationship of a landlord and tenant is created between Cole Ambrose Ltd and the User (or their visitors); and
3.1.2. Cole Ambrose Ltd retains control, possession and management of Ely Dog Park and the User has no right to exclude Cole Ambrose Ltd from Ely Dog Park.
Cole Ambrose Ltd reserves the right to enter Ely Dog Park at all times during the booking.
3.2. Cole Ambrose Ltd is not liable for the acts or omissions of third parties carrying out activities on land adjacent to the Ely Dog Park.
3.3. The User and visitors agree and undertake:
3.3.1. Not to use Ely Dog Park other than for the booking;
3.3.2. Not to do or permit to be done anything which is illegal or which may be or become a nuisance (whether actionable or not), annoyance, inconvenience or disturbance to Cole Ambrose Ltd or to any other Users of Cole Ambrose Ltd, or any owner or occupier of neighbouring property;
3.3.3. Not to smoke or permit smoking (including e-cigarettes/Vapes) anywhere on- site;
3.3.4. Not to have or permit open fires or barbeques anywhere on-site.
4. Risk and liability
4.1. The use of Ely Dog Park is entirely at the User’s own risk. Cole Ambrose Ltd accepts no liability for the death of, or injury to, any person or dog using the facility, or damage to any property. Cole Ambrose Ltd accepts no liability for losses, claims, actions, damages, expenses, or any other liability incurred by you whilst at Ely Dog Park.
4.2. Ely Dog Park is a large area of former agricultural grazing, with the potential for uneven ground, vegetation, branches, stones and other potential hidden hazards, which are consistent with the countryside. You acknowledge that the nature and condition of Ely Dog Park will vary depending on the season and/or weather at the time.
4.3. The behaviour and actions of the User’s dog(s) are the User’s sole responsibility. Cole Ambrose Ltd accepts no liability for the behaviour and actions of the User’s dog(s).
4.4. Visitors and users must report any accident, injury or incident to Cole Ambrose Ltd immediately by calling the number provided in your booking confirmation.
4.5. All Dog Trainers must have Professional Indemnity and Public Liability Insurance prior to using Ely Dog Park. A copy must be provided to Cole Ambrose Ltd on request.
4.6. Professional Dog Walkers must have Public Liability Insurance. A copy must be provided to Cole Ambrose Ltd on request.
5. Personal Safety and Children
5.1. Users are welcome to bring friends and family to walk your dog(s). In doing so, Users agree to take full responsibility for their safety and ensure that they abide by the terms and conditions for the use of Ely Dog Park.
5.2. User’s agree not to let anyone else into Ely Dog Park other than friends and family that they intended to use Ely Dog Park with.
5.3. Cole Ambrose Ltd permit children under the age of 18 to attend Ely Dog Park with an adult present. Children must not be left unattended or unsupervised in Ely Dog Park at any time.
5.4. All Users, including children users, must respect Ely Dog Park and its contents. This includes, but is not limited to, not climbing on the fences, gates, or any equipment.
6. Dog safety
6.1. Dogs must never be left unattended in Ely Dog Park. Users should ensure that they take all necessary precautions and that their dog(s) always remains within eyesight.
6.2. It is the responsibility of Users and visitors to assess whether the boundaries are suitable for their dog(s) before letting them out of any vehicle or off the lead. The fences and gates are designed to minimise the chance of escape however Cole Ambrose Ltd accepts no responsibility or liability for dogs that escape Ely Dog Park.
6.3. If you notice any damage to the fences and gates or any issue relating to them, you must stop using Ely Dog Park immediately, secure your dog(s) and inform Cole Ambrose Ltd by contacting them on the number provided in your booking confirmation. You must not resume using Ely Dog Park until Cole Ambrose Ltd have informed you that the issue has been resolved.
6.4. Dogs must be accompanied in Ely Dog Park by an adult at all times.
6.5. Dogs must remain on leads if you need to access a field at Ely Dog Park from the communal parking area to ensure the safety of other users, members of the public, nearby road users, and your dog(s).
6.6. Dog owners must adhere to the following medical conditions:
6.6.1. Dogs must regularly be treated for flea, tick and worm prevention and be fully vaccinated before using Ely Dog Park.
6.6.2. Users must not bring dogs to Ely Dog Park if they have been unwell during the last 48 hours. This includes, but is not limited to, kennel cough, sickness and diarrhoea.
6.7. Cole Ambrose Ltd reserve the right to ask you for supporting evidence to satisfy these medical requirements and decline access if you fail to satisfy this condition.
6.8. Cole Ambrose Ltd reserve the right to cease any hire agreements with immediate effect should they deem any dog to be unsuitable due to their behaviour or health condition.
7. Dangerous Dogs
7.1. Users and their dogs must comply with the Dangerous Dogs Act 1991 at all times when visiting Ely Dog Park.
7.2. The breeds of dog currently listed under the Dangerous Dogs Act 1991 are:
7.2.1. The Pit Bull Terrier;
7.2.2. The Japanese Tosa;
7.2.3. The Dogo Argentino;
7.2.4. The Fila Brasilerio; and
7.2.5. The XL Bully Dog.
7.3. Dogs who are dangerously out of control also fall under the Dangerous Dogs Act 1991. Cole Ambrose Ltd do not permit dangerously out of control dogs at Ely Dog Park in the interests of safety of the public, other users of Ely Dog Park and other dogs present at Ely Dog Park. Cole Ambrose Ltd reserve the right to cease any hire agreements with immediate effect if they consider, at their absolute discretion, that a dog present at Ely Dog Park is dangerously out of control.
7.4. Dogs on the list of banned and dangerous dogs are permitted at Ely Dog Park if the Government’s guidance and legislation are followed at the time of your booking and for the duration of your visit to Ely Dog Park.
7.5. Users are responsible for keeping up to date and compliant with the latest Government guidance and legislation regarding banned and dangerous dogs at all times when using Ely Dog Park. If Government guidance and legislation has changed between the time of your booking and your visit to Ely Dog Park, it is your responsibility to adhere to the updated guidance and/or legislation.
7.6. With reference to XL Bully dogs:
7.6.1. Users will be required to keep XL Bully Dogs on a lead and muzzled when in the communal areas at Ely Dog Park; including the access tracks and car park. This also applies when your dog is inside a vehicle.
7.6.2. An XL Bully Dog must be on a lead and muzzled inside the secure field if there is more than one dog and/or person using Ely Dog Park under your booking. This rule applies even if the additional dogs and people form part of the same household.
7.6.3. An XL Bully Dog can only be let off the lead and unmuzzled inside the secure field if there is a maximum of one dog and one person using Ely Dog Park under your booking. The dog and person must be inside one of the secure fields with the gate locked.
7.6.4. Users must have a certificate of exemption for your dog.
7.6.5. You must hold third party Public Liability Insurance cover for your dog. A copy must be provided to Cole Ambrose Ltd on request.
7.6.6. Cole Ambrose Ltd reserve the right to ask you for supporting evidence to satisfy these requirements and decline access if you fail to satisfy this condition.
7.7. Cole Ambrose Ltd reserve the right to cease any hire agreements with immediate effect if they consider the above terms and conditions have not been adhered to.
8. Parking and Valuables
8.1. Users vehicle(s) or any property brought to Ely Dog Park is done so at users own risk. Cole Ambrose Ltd shall not be liable for damage or theft of any property of any of the visitors to Ely Dog Park. Any valuable items should not be left vehicles.
8.2. You should only park in the communal parking area if you are waiting for your session to start or if you and your friends/family have arrived in multiple vehicles.
8.3. You should respect other users of Ely Dog Park and Ben’s Yard by not permitting your dog to jump out of your vehicle whilst waiting to enter a field at Ely Dog Park. Dogs can only be let off their lead when they are securely in the field.
9. Entering and exiting Ely Dog Park
9.1. Please ensure that you arrive on-time and remain in your car with your dogs in the communal parking area until the previous user has vacated Ely Dog Park.
9.2. At the start of your session, you must unlock the gate and drive your vehicle into the secure field designated to you and park on the designated hardstanding area. You must ensure that the access gate is shut behind you when entering the field. There is space for one car in each field and additional vehicles should be left in the communal parking area.
9.3. User’s dog(s) must remain on a lead or in a vehicle until the gate is closed.
9.4. Please vacate the Field/Paddock by the end of your session, so that the next visitor can enjoy their full booking. You should allow enough time within your session to clear up dog poo and collect your possessions.
9.5. You must ensure that the gate is locked behind you at the end of your session.
10. Waste
10.1. Dog poo bins are provided in Ely Dog Park. You must pick up your dog poo and dispose of it in the bins provided or take it away with you. If you are able bodied, you should walk with / remain with your dogs at all times so that you are able to pick up your dog poo effectively.
10.2. All other litter must be collected and taken away with you. Please do not dispose of it in the dog poo bins.
11. Etiquette
11.1. Please enjoy and respect the countryside whilst walking your dog(s). By agreeing to these terms and conditions, Users agree not to do anything which may diminish the enjoyment of other visitors and Users.
11.2. All toys and apparatus that you may bring must be taken away with you. Complete or broken toys can be a choke hazard for dogs and must be removed.
11.3. Please discourage your dogs from digging in Ely Dog Park but if they do so, any holes must be filled by the User as soon as possible and reported to the phone number provided before you leave Ely Dog Park.
11.4. You must not groom your dogs at Ely Dog Park. Hair from dogs that have been treated for fleas is dangerous for wildlife including nesting birds.
11.5. The adjacent land is actively farmed and grazed with livestock. Please respect the livestock and prevent your dogs from worrying and/or startling them. It is an offence to permit dogs to worry livestock under Section 1 of Dogs (Protection of Livestock) Act 1953.
11.6. Ely Dog Park is in the open countryside, however you must respect any users
of the other paddock at Ely Dog Park and any neighbours, including members of the Public enjoying the Stuntney Estate walks. If your dog persistently barks, Cole Ambrose Ltd can at their absolute discretion, ask you to leave Ely Dog Park and prevent you from using Ely Dog Park again in the future.
11.7. You must not take photos of other user(s) of Ely Dog Park or their dogs and or post the photos on social media without the explicit consent of the persons in the photographs or the owners of the dogs in the photographs.
12. Data Protection and Privacy
12.1. As part of the booking process Cole Ambrose Ltd will be required to act as a data controller as it will need to gather and use your personal data.
12.2. Cole Ambrose Ltd reserves the right to operate CCTV for the purposes of security and crime prevention.
12.3. Cole Ambrose Ltd will ensure that it complies with the requirements of all applicable data protection and privacy legislation in force from time to time in the UK including the Data Protection Act 2018 (and regulations made thereunder), the
retained EU law version of General Data Protection Regulation ((EU) 2016/679), the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426).
12.4. Cole Ambrose Ltd will not pass your information on to any third parties, including other users of Ely Dog Park, unless required to by law.
